Terms and Conditions

These Terms and Conditions apply to all driving lessons, refresher lessons, mock tests, motorway lessons, block bookings and intensive courses provided by Cheltenham Driver Training, operated by Richard Bailey.

By booking a lesson, paying for a lesson, or continuing to use our services, you agree to these Terms and Conditions.

Lessons are normally available Monday to Friday, 8:00am to 4:30pm, Saturday, 8:00 AM – 12:00 PM subject to availability.

2. Services Provided

Cheltenham Driver Training provides driving tuition in Cheltenham, Gloucester, Tewkesbury, Gloucestershire and surrounding areas.

Services may include:

  • Manual driving lessons
  • Automatic driving lessons
  • Block bookings
  • Intensive courses
  • Refresher lessons
  • Motorway lessons
  • Mock theory tests
  • Mock practical tests
  • Test-day preparation and vehicle hire, where agreed

All lessons are tailored to the learner’s ability, progress, confidence and safety.

3. Learner Requirements

Before taking any lesson, you must:

  • Hold a valid UK provisional or full driving licence suitable for the vehicle being driven.
  • Be legally entitled to drive in the UK.
  • Meet the legal eyesight standard for driving.
  • Tell us about any medical condition, medication, disability or licence restriction that may affect your ability to drive.
  • Wear glasses or contact lenses during lessons if required for driving.
  • Bring your driving licence to your first lesson and whenever requested.

Cheltenham Driver Training may refuse or stop a lesson if you cannot meet these requirements.

4. Under-18 Learners

Learners under 18 must have consent from a parent or guardian before booking lessons.

The parent or guardian is responsible for payment, cancellations and communication where agreed.

5. Lesson Bookings

Lessons are booked directly with Richard by phone, WhatsApp, email or another agreed method.

A booking is confirmed when:

  • A lesson date and time has been agreed; and
  • Any required payment or deposit has been received.

Lesson times include any agreed pick-up and drop-off arrangements.

Pick-up may be from home, work, school, college or another agreed location within the service area.

6. Lesson Prices

Current standard lesson prices are:

  • 1-hour lesson: £35
  • 2-hour lesson: £70

Block booking and intensive course prices are agreed separately.

Prices may change from time to time. Any lessons already paid for will be honoured at the price agreed at the time of booking.

7. Payment

Payment may be made by:

  • Bank transfer
  • Cash

Payment is due before or at the start of each lesson unless agreed otherwise.

Block bookings and intensive courses must be paid in advance unless a different arrangement has been agreed in writing.

Cheltenham Driver Training may refuse further lessons if payment is overdue.

8. Block Bookings

Block bookings must be paid in advance.

Block booking hours are valid for 6 months from the date of payment unless agreed otherwise.

Block bookings are for the named learner only and cannot be transferred to another person without written agreement.

If you cancel a block booking, unused hours may be refunded. Lessons already taken will be charged at the standard hourly rate before any refund is calculated.

9. Intensive Courses

Intensive courses are arranged around instructor availability, learner ability, test availability and safe progress.

Booking an intensive course does not guarantee that you will be ready for test by a specific date.

Cheltenham Driver Training may recommend extra lessons if further training is required.

10. Cancellations by the Learner

You must give at least 48 hours’ notice to cancel or rearrange a lesson.

If less than 48 hours’ notice is given, the full lesson fee may be charged.

If you do not attend a lesson, the full lesson fee may be charged.

If you are late, the lesson will still finish at the agreed time unless Richard is able to extend it. No refund will be given for time lost due to lateness.

Exceptional circumstances may be considered at Richard’s discretion.

11. Cancellations by Cheltenham Driver Training

Cheltenham Driver Training may cancel or rearrange a lesson due to:

  • Vehicle issues
  • Illness
  • Unsafe weather
  • Road conditions
  • Personal emergency
  • Any other reason affecting safety or availability

If Cheltenham Driver Training cancels a lesson, you will be offered a rearranged lesson or a refund for the cancelled lesson.

Cheltenham Driver Training is not responsible for additional costs caused by a cancellation, except where required by law.

12. Cooling-Off Rights

If you book lessons online, by phone, WhatsApp or email, you may have a 14-day cooling-off period under UK consumer law.

You may cancel during this period and receive a refund for unused services.

If you ask for lessons to start during the 14-day cooling-off period, you agree that:

  • Cheltenham Driver Training may begin providing the service; and
  • You must pay for any lessons or services already provided before cancellation.

Once a service has been fully completed, you may lose the right to cancel that service.

13. Refunds

Refunds are made to the original payer where possible.

Refunds may be reduced to account for:

  • Lessons already taken
  • Late cancellations
  • No-shows
  • Any agreed non-refundable deposit
  • Any third-party costs already incurred

Refunds are normally processed within 14 days of agreement.

14. Fitness to Drive

You must be fit to drive at the time of every lesson.

You must not attend a lesson if you are affected by:

  • Alcohol
  • Illegal drugs
  • Prescription or over-the-counter medication that affects driving
  • Extreme tiredness
  • Illness that affects safe driving
  • Any condition that makes driving unsafe

Richard may stop or refuse a lesson if he believes you are not fit to drive. In that case, the lesson fee may still be charged.

15. Safety and Conduct

You must follow Richard’s reasonable instructions during lessons.

Cheltenham Driver Training may stop a lesson immediately if you:

  • Drive dangerously
  • Ignore safety instructions
  • Behave aggressively
  • Use abusive language
  • Damage the vehicle deliberately or recklessly
  • Put yourself, the instructor, pedestrians or other road users at risk

Repeated or serious misconduct may result in termination of further lessons.

16. Use of the Training Vehicle

Lessons will normally take place in a suitable insured training vehicle.

You must treat the vehicle with care.

You may be responsible for damage caused by deliberate, reckless or grossly careless behaviour.

Smoking, vaping, eating and drinking are not permitted in the vehicle unless agreed.

17. Lessons in Your Own Vehicle

Lessons in your own vehicle are not permitted. 

18. Driving Tests

You are responsible for booking and paying for your theory and practical driving tests unless agreed otherwise.

You must only book a practical test after discussing readiness and vehicle availability with Richard.

Booking a test does not automatically guarantee use of the training vehicle.

Cheltenham Driver Training may refuse use of the vehicle for a driving test if Richard believes:

  • You are not test-ready
  • You are unsafe
  • The vehicle is unavailable
  • The test booking was made without agreement
  • Legal or insurance requirements are not met

Test-day charges will be agreed in advance and may include warm-up time, use of the vehicle during the test and return travel.

If the DVSA cancels your test, any lesson time already used may still be charged. Unused paid time may be credited or refunded.

19. Mock Tests

Mock theory and mock practical tests may be included with full courses where agreed.

Free mock tests have no cash value and cannot be exchanged for money or transferred to another learner.

Mock test results are for training purposes only and do not guarantee the outcome of any official test.

20. No Guarantee of Passing

Cheltenham Driver Training will provide professional tuition and honest guidance.

No guarantee is made that you will pass your theory or practical driving test.

Driving-test results depend on your ability, progress, preparation, conduct, road conditions, test circumstances and examiner assessment.

21. Instructor Availability

Lesson availability may vary.

Cheltenham Driver Training will try to offer regular lesson times, but the same day or time cannot always be guaranteed.

22. Communication

Cheltenham Driver Training may contact you by phone, WhatsApp, text message or email about:

  • Lesson bookings
  • Payments
  • Cancellations
  • Test arrangements
  • Progress updates
  • Safety matters

You must provide accurate contact details and keep them updated.

23. Personal Data

Cheltenham Driver Training will only collect and use personal information needed to manage bookings, payments, tuition, safety, communication and legal obligations.

This may include:

  • Name
  • Contact details
  • Driving licence information
  • Lesson records
  • Payment records
  • Relevant health or driving information

Personal data will not be sold to third parties.

Information may be shared where necessary with insurers, legal advisers, regulators, the DVSA or other authorities where required by law.

24. Photos, Reviews and Publicity

Cheltenham Driver Training may ask to take photographs or use reviews for marketing purposes.

Photos, pass announcements and reviews will only be used with your consent.

You may withdraw consent for future use by contacting Cheltenham Driver Training.

25. Website Information

Cheltenham Driver Training aims to keep website information accurate and up to date.

Prices, services, availability and coverage areas may change.

Website content is for general information only and does not override any specific written agreement made with you.

26. Intellectual Property

All website text, branding, images and materials belonging to Cheltenham Driver Training must not be copied, reproduced or used without permission.

27. Complaints

If you have a complaint, contact Cheltenham Driver Training as soon as possible.

Please provide:

  • Your name
  • Lesson date
  • Details of the issue
  • What outcome you are seeking

Cheltenham Driver Training will review the complaint and respond within a reasonable time.

28. Liability

Cheltenham Driver Training is responsible for providing driving tuition with reasonable care and skill.

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence
  • Fraud
  • Breach of statutory rights
  • Any liability that cannot legally be excluded

Cheltenham Driver Training is not responsible for losses caused by learner conduct, DVSA decisions, test cancellations, traffic conditions, weather, or events outside reasonable control.

29. Ending Lessons

You may stop taking lessons at any time.

Cheltenham Driver Training may stop providing lessons if:

  • Payments are overdue
  • You repeatedly cancel at short notice
  • You behave unsafely or abusively
  • You fail to meet legal driving requirements
  • There is a breakdown in trust or communication

Any refund for unused prepaid lessons will be calculated under these Terms.

30. Changes to These Terms

Cheltenham Driver Training may update these Terms from time to time.

The latest version will apply to new bookings.

For lessons already booked and paid for, the terms agreed at the time of booking will apply unless a change is required by law or agreed with you.

31. Governing Law

These Terms are governed by the laws of England and Wales.

Any dispute will be dealt with by the courts of England and Wales, unless consumer law gives you the right to bring proceedings elsewhere.

32. Acceptance

By booking, paying for, or attending a lesson with Cheltenham Driver Training, you confirm that you have read, understood and agreed to these Terms and Conditions.
